[Phys-L] Re: Kitzmiller vs DASD



Hi all-
The cite, as I've got it, is to the direct testimony in the
Morning (37 pp). It is, of course, rehearsed - it would be malpractice
not to do so. I've not found any cross, except on the limited issue of
whether Miller would be qualified as an expert. The Defense did not
really challenge his credentials.
Legal proceedings have their own logic. I'll try to keep the list
informed, as I have the opportunity to read the transcripts.
The parties' respective strategies are set out in the opening
statements of the attorneys. Plaintiffs' first witness is laying out
Plaintiffs' case according to plan. It will be interesting to see if
defendants attack his testimony on cross-examination, or simply rely on
contradictory testimony. Defendants' burden may only be to demonstrate
that there is a conflict of scientific views that should be presented to
the students.

I found Ken Miller's direct testimony fascinating. He did a terrific job.
The
cross however was a boring word sparring as the attorney tried to get Miller
to
use certain words to describe Darwin's theory.
